A new set of rules and regulations has been released by the US Citizenship and Immigration Services (USCIS) and has increased the minimum investment limit under the EB-5 program.
The EB 5 visa allows individuals to apply for permanent residentship in the United States under the US immigration rules if necessary investment is made in a commercial enterprise in the United States. It remains applicable for those preserving 10 full-time jobs for qualified United State workers.
In China, the program is very popular and many Chinese and Indians are opting for this route to get permanent residency in the US.
Depending on the nature of the environment areas in the US the amount of investment will vary. The EB 5 Visa rule will be effective from November 21, 2019 and the standard minimum investment level will increase from $1 million to $1.8 million.
Since 1990, this will be the first increase and it accounts for inflation. In the targeted employment area (TEA) the minimum investment amount will be increased from $500,000 to $900,000.
There will be an automatic adjustment in inflation every five years. The non TEA minimum limit will be $1.8 million and as per the rule, there will be a 50 percent minimum investment differential between TEA and a non-TEA.
But for those willing to latch on to the lower limit before the last date of EB 5 Visa USA there will be a window of opportunity.
Rogelio Caceres, Co-Founder and CCO of LCR Capital Partners said that since the fee hike would be put in place with effect from 21st November 2019, it gives applicants approximately 3 months to invest in the program at the current price. It is therefore crucial for interested applicants to speed up their decision-making process – as the procedure of validating their source of funds would also take a significant amount of time.
